According to Yonhap News on November 29, Seoul Gangnam Police Station decided not to refer Choi Minhwan‘s case to the prosecution, citing insufficient evidence to support charges of violating the Prostitution Punishment Act or forced indecency.
Previously, Yulhee alleged that Choi Minhwan frequently visited adult entertainment establishments during their marriage. This prompted netizens to file complaints through the public online petition platform, leading to a police investigation.
Subsequently, Yulhee expressed her desire to regain custody of her children, filing a mediation request against Choi Minhwan for changes to custody and parental rights, as well as property division.
Yang Soyeong, Yulhee’s legal representative, shared on her personal YouTube channel community on November 5, “Yulhee has filed a mediation request against her ex-husband Choi Minhwan for changes to custody and parental rights, alimony, and property division. We are also proceeding with a request for a ‘temporary caregiver designation and a preliminary ruling on child support’ to ensure she can be reunited with her children as soon as possible.”
Although Choi Minhwan has been cleared of allegations regarding the Prostitution Punishment Act and forced indecency, attorney Yang Soyeong emphasized that the case was initially separate from the custody mediation. She stated, “This case is not a decisive reason for the mediation request. It was not initiated with the purpose of punishment but rather to clear up misunderstandings Choi Minhwan faced and to secure his rights for the future. Notably, Yulhee’s side did not file the complaint either.”
She added, “However, whether or not someone actively fulfilled their parenting responsibilities could be a point of discussion. If Yulhee had intended to pursue punishment, she would have actively cooperated with the investigation. The case, however, is not a critical factor in the custody mediation.”
Previously, Yang Soyeong had argued, “From what I’ve gathered, when determining custody at the time of the divorce, there was an understanding that, rather than Choi Minhwan raising the children long-term, Yulhee would eventually take them back. Based on this, I believe the chances of success are high.”
Yulhee and Choi Minhwan married in 2018 and have three children, one son and two daughters. However, they announced their divorce in December last year, with custody initially granted to Choi Minhwan. He later appeared on KBS2’s reality show “The Return of Superman” with their three children, while Yulhee pursued a career as an influencer.
